1. The short version

We ask for your name and phone number so we can bill the sale, handle exchanges and let you know about offers. We do not sell your information to anyone. You can ask us to stop messaging you at any time.

This policy explains how SMILEY Mens Wear, 001/1 Kalaimagal Kalvi Nilayam Road, Brough Road, Erode 638001, handles personal information, in line with the Digital Personal Data Protection Act, 2023 and other applicable Indian law.

2. What we collect

  • At the billing counter: your name and mobile number, and the items, amount and date of your purchase.
  • For a business invoice: your firm's name, address and GSTIN, if you ask for the bill in a company name.
  • If you contact us: the name, phone number, email and message you send through the enquiry form on this site, or through WhatsApp.
  • For alterations and orders: measurements and the delivery date agreed with you.
  • In the shop: CCTV recordings of the premises.

We do not ask for and do not store your card number, CVV, UPI PIN or bank password. Card and UPI payments are handled entirely by the machine or app of the bank or payment provider.

3. Why we collect it

  • To raise a GST invoice and meet our tax and accounting obligations.
  • To trace your bill when you come back for an exchange, alteration or warranty claim.
  • To call or message you when an alteration or order is ready.
  • To tell you about offers, new stock and festival sales, where you have agreed to receive them.
  • To answer enquiries you send us.
  • To keep the shop, our staff and our stock safe.

4. WhatsApp and SMS

If you give us your mobile number, we may send you your bill, order updates and occasional offers by SMS or WhatsApp. Order and bill messages are part of the service. Promotional messages are sent only where you have not opted out.

To stop promotional messages, reply STOP on WhatsApp, tell us at the counter, or call +91 73392 77522. We will remove you from the list. You will still receive messages relating to a specific purchase or order.

5. CCTV in the shop

The shop premises are under CCTV surveillance for the safety of customers, staff and stock. Recordings are kept for a limited period on our own equipment and are viewed only by the owner or authorised staff, or shared with the police or a court where legally required.

6. Who we share it with

We do not sell, rent or trade your personal information. We share it only where necessary, with:

  • our billing and point-of-sale software provider, who stores the shop's records on our behalf;
  • banks and payment providers, to process and settle payments;
  • the messaging provider that delivers our SMS and WhatsApp messages;
  • our accountant and the tax authorities, for GST returns and audits;
  • brands or suppliers, where a warranty or defect claim has to be assessed by them;
  • any authority, where we are required to disclose information under law.

7. How long we keep it

Invoice and accounting records are kept for the period required by GST and income tax law, which is generally up to eight years. Contact and offer lists are kept until you ask us to remove you. CCTV footage is overwritten automatically after a short retention period unless it is needed for an incident.

8. How we protect it

Access to our billing system is restricted to the owner and authorised staff with their own logins. Paper records are kept at the shop premises. This website is served over HTTPS. No system is perfect, but we take reasonable steps to keep your information from being lost, misused or disclosed without permission.

9. Your rights

You can ask us to:

  • tell you what personal information we hold about you;
  • correct anything that is wrong or out of date;
  • delete your contact details from our records, where we are not required by law to keep them;
  • stop sending you promotional messages.

Call +91 73392 77522 or come to the shop with your bill and we will act on your request. We may ask you to confirm your identity first. If you are not satisfied with how we have handled your request, you may raise the matter with the Data Protection Board of India.

10. This website and cookies

This site does not use advertising or tracking cookies and does not build a profile of your visit. It loads fonts from Google Fonts, and the map on the contact page is embedded from Google Maps; those services receive your IP address and are governed by Google's own privacy policy. If you submit the enquiry form, the details you type are emailed to the shop and are not published anywhere.

11. Children

This website is meant for adults. We do not knowingly collect information from children. Where a purchase is made for a child, the details we record are those of the accompanying adult.

12. Changes to this policy

We may update this policy as our practices or the law change. The revision date at the top of this page shows when it was last changed. Please check back from time to time.
